Jivora Health ("Jivora," "we," "us") operates at the intersection of biotechnology, personalized wellness, and digital health. We believe your health data is your most personal asset. This policy governs our "Platform"—including jivora.co, jivora.health, our mobile applications, and our diagnostic testing ecosystem.

By using the Platform, you acknowledge the collection and use of data as outlined herein. If you do not agree, please discontinue use immediately.

2. INFORMATION WE COLLECT

We collect data through direct input, automated tracking, and clinical integrations.

2.1 Personal & Professional Identifiers

  • Users: Name, email, shipping/billing address, and date of birth.

  • Practitioners: License numbers (NPI), professional credentials, and business affiliations.

2.2 Health & Biometric Data (Sensitive Personal Information)

As a health-focused platform, we collect Sensitive Personal Information (SPI):

  • Clinical Data: Results from at-home diagnostic kits (processed via CWI Physician Partners).

  • Biometric Data: Biological samples (blood, saliva, or DNA) required for specific testing.

  • Wellness Inputs: Dietary habits, supplement history, and health goals.

2.3 Automated & AI Usage Data

  • Technical Identifiers: IP addresses, device IDs, and browser cookies.

  • AI Interaction: Queries and interactions with our automated recommendation engines (e.g., supplement suggestions).

3. HOW WE USE YOUR DATA

We process data only when there is a clear legal or functional necessity.

  • Service Fulfillment: Processing orders, managing lab logistics, and delivering results.

  • AI-Assisted Personalization: Using algorithms to analyze your wellness markers and suggest tailored supplement protocols. Note: AI suggestions do not replace professional medical advice.

  • Regulatory Compliance: Meeting HIPAA, CCPA/CPRA, and FDA record-keeping requirements.

  • Security: Fraud detection and safeguarding the integrity of our clinical databases.

4. SHARING & DISCLOSURE

Jivora does not sell your personal or health data. Disclosure occurs only in the following contexts:

  • Clinical Partners: Your samples and identifiers are shared with CWI Physician Partners P.C. and authorized laboratories for the sole purpose of diagnostic analysis.

  • Business Associates: Secure cloud providers (SOC 2 Type II) and PCI-compliant payment processors.

  • Sovereign Ecosystem: Limited data sharing between Jivora affiliates (e.g., Zenmen Health) to ensure a seamless wellness experience across our brands.

  • Legal Necessity: Compliance with subpoenas or government health reporting mandates.

5. DATA SECURITY & RETENTION

We implement a "Defense in Depth" strategy to protect your information.

  • Encryption: AES-256 at rest and TLS 1.3 in transit.

  • Clinical Retention: Health and lab records are retained for a minimum of 7 years to comply with HIPAA and medical record laws.

  • Biometric Destruction: Biological samples are destroyed by our lab partners immediately after successful analysis, unless further retention is requested for longitudinal study.

  • Account Deletion: Non-clinical data (marketing preferences, etc.) can be deleted upon request, subject to a 3-year verification audit trail.

6. YOUR RIGHTS & CHOICES

Depending on your jurisdiction (including CA, CO, VA, and CT), you have the following rights:

  1. Right to Know & Access: Request a copy of all data Jivora holds about you.

  2. Right to Delete: Request the permanent removal of your personal information (excluding records required by clinical law).

  3. Right to Correct: Update inaccurate health or contact information.

  4. Limit SPI Use: You may restrict how we use your sensitive health data for non-essential purposes.

  5. Opt-Out of Automated Decision-Making: You may opt-out of having your health profile analyzed by AI for marketing purposes.

7. AUTHORIZATION FOR DIAGNOSTIC TESTING

By engaging with Jivora’s diagnostic services, you provide the following explicit authorizations:

  • Consent to Test: You voluntarily authorize CWI Physician Partners to order and review diagnostic screenings on your behalf.

  • International Transfer: You acknowledge that specimens may be processed in laboratories outside your home jurisdiction, provided equivalent data protections are in place.

  • No Physician-Patient Relationship: You understand that Jivora’s automated insights and CWI’s diagnostic authorizations are for informational and diagnostic assistance only and do not constitute primary medical treatment.

  • Communication: You authorize Jivora to contact you via encrypted text or email regarding your results.
